1. General
The following terms and conditions (Terms), together with the documents referred to, are legally binding and govern the supply of any of the Products listed on our Sales Platforms. By accessing our Platforms and/or placing an order for any of our Products, you agree to be
bound by these Terms. Accordingly, you are advised to read these Terms carefully before ordering any Products.

If you do not accept these Terms and do not wish to be bound by them, then you are strongly advised to not order Products from our Platforms. If you have any questions regarding these Terms please email us at empoweredcrystal.uk@gmail.com.

1.1 Definitions

Content – means any content in any form published by us or any third party with our consent
Personal Information – means the details provided by you when registering
Product(s) – means an item or items for sale
Product Description – means the specific terms and conditions provided for individual products listed
Special Conditions – means the specific terms and conditions in the Product Description
Terms – means these terms and conditions
United Kingdom – means England, Wales, Scotland, Northern Ireland and the Channel Islands
Users – means the users of our Platforms collectively
We/us – means Empowered Crystals
You – means a user of our Platforms.

1.2 Privacy policy
Our full Privacy Policy stating how we collect, use and store your personal information can be accessed HERE. By accessing and using our Platforms you acknowledge that you have read, understood and agree to be bound by our Privacy Policy.

If you do not accept our Privacy Policy, you are advised not to use our Platforms or order Products.

2. Use of Platforms

2.1 Purchasing and age restrictions
To purchase Products you must be 18 years of age or the age of majority in your province, territory or country and have the legal capacity to form a binding contract with the business partnership Empowered Crystals.

If you are under the age of 18, or under the of majority in your province, territory or country, or do not have the capacity to form a binding legal contract with Empowered Crystals, you may use our Platforms to purchase Products only with the consent and involvement of a
parent or legal guardian, subject to their acceptance of these Terms, as well as their acceptance of responsibility and liability for your purchase(s).

You agree to use our Platforms only for lawful purposes in accordance with these Terms and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, these Platforms by anyone else. You agree and accept that accessing the Platforms is entirely
at your own risk.

2.2 Personal Information
You guarantee that the Personal Information you submit is accurate, true, current and complete in all respects and you will update us immediately if your Personal Information changes.

You agree not to use a false name, a name you are not authorised to use and not to impersonate any other person or entity.

You are responsible for maintaining the confidentiality of your account and password, and for preventing any unauthorised person from using your account.

You agree to accept responsibility for all activities that occur under your account or password. You should tell us immediately if you believe some person other than yourself has accessed your account without your authority.

Please note, if you are accessing the Platforms from locations outside the UK, you are responsible for your compliance with local laws, where applicable.

We update our Platforms on a regular basis. We reserve the right to change, amend or remove content at any time without prior notice.

2.3 Restrictions on what you may post to our Platforms
You agree that you will not use or allow anyone else to use the Platform to post content in reviews, comments and FAQs which is or may:

be malicious or defamatory
be illegal, obscene, offensive, threatening or violent
be sexually explicit or pornographic
be likely to deceive any person or be used to impersonate any person, or to misrepresent your identity, age or affiliation with any person
give the impression that it emanates from us or that you are connected with us or that we have endorsed you or your business
solicit passwords or personal information from anyone
be used to sell any goods or services or for any other commercial use
include anything other than words (i.e. you will not include any symbols or photographs)
link to any of the material specified above, in this paragraph
send age-inappropriate communications or content to anyone under the age of 18.
be a review that is false or misleading
be a campaign to encourage others to post reviews, whether positive or negative

3. Description of products
Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times.

We will take all reasonable care to ensure that all descriptions, details and prices of Products appearing are correct at the time when the relevant information was entered onto the system, but occasionally pricing errors may occur. If we have made an error in the price of a product that you have ordered, you will be contacted and will have the option to reconfirm your order
at the correct price or cancel it.

Although we aim to keep information as up to date as possible, the information including Product Descriptions appearing at a particular time may not be up to date at the moment you place an order. By purchasing a Product, you acknowledge and agree that this may be the
case and that this will not absolve you of the rights and obligations as set out in these Terms.

We reserve the right to change the price of Products at any time without prior notice. We agree that any changes in price will not affect the price charged to you at the time your purchase of those Product(s) are confirmed.

We make every effort to reproduce colours as accurately as possible. However, different computers and mobile devices may reproduce colours in slightly different ways, so exact colour matches may not be possible. This means that the colour of Products ordered may
differ from what you see on the screen.

4. Ordering

4.1 Contract creation
These Terms constitute the entire and exclusive understanding and agreement between you and Empowered Crystals and the sale of our Products, and these Terms supersede and replace any and all previous oral or written, correspondence, arrangements, understandings or
agreements between the parties.

Each party acknowledges that, in entering into this agreement, they do not rely on any representation, warranty, information or document or other term not forming part of these Terms.

If you make a purchase on behalf of another person you warrant that you have full authority to do so and you accept personal responsibility for your purchase.

Should you purchase Products from us under an arrangement which does not involve your payment via the agreed procedure; you agree and accept to be bound by these Terms insofar as they can be applied.

Please note that we do not deliver our Products to all countries and so we may decline orders and purchases of our Products where they are to be delivered to countries we do not serve.

4.2 Acceptance of your order
Prior to completing your order, you will be given the opportunity to confirm the details of your order, including your billing address, delivery address and payment details.

We will send an order confirmation email detailing the products you have ordered to the email address you provide in your registration form. This does not constitute acceptance of your order.

Order acceptance will take place once the Products you have ordered have been dispatched to you. An email will be sent to you to notify you that your order has been fulfilled.

We may be unable or refuse to accept your order because:

One or more of the Products may not be available
Our inability to obtain authorisation for your payment
You fail to comply with these Terms
A pricing or product description error has been identified

If we are unable to accept your order due to one or more of the Products not being available, or a pricing or Product Description error has been identified, authorisation for your payment has failed or there has been a breach of our Terms, we will issue a refund for the Product(s)
ordered. You will be notified via email and we aim to refund you within 14 days.

4.3 Price and payment
Depending on your delivery address, different taxation rules and additional charges may apply. If you request that your purchase(s) are to be shipped to an address outside of the United Kingdom, you may need to pay import duties upon receipt of the products. You will
be responsible for payment of any such import duties and taxes. We cannot advise on the amount of any charges payable and do not have control over the charges. Please contact your local Customs office for further information before placing your order.

Charges relating to payment in a currency other than British Pounds Stirling will be borne by you, including bank charges for currency conversions.

Any information given by us in relation to exchange rates are approximate only and may vary from time to time.

4.4 Security of your credit card
Card payments are not processed through pages controlled by us. We use one or more online payment service providers who will encrypt your card or bank account details in a secure environment. We do not assume any responsibility for services and transactions between you
and these third-party online payment service providers. Any such dealings are solely between you and the third party and we will not be responsible for any loss or damage incurred as the result of any such dealings or with respect to any third-party’s use or disclosure of your
personal information that you make available to them. If there is a dispute we are under no obligation to become involved and you agree not to involve Empowered Crystals.

5. Delivery

5.1 Delivery of Products
We endeavour to ensure Products are delivered within 30 days from the day you place an order to purchase the Products.

Deliveries will be made by our chosen carrier to the delivery address stipulated in your order. You must ensure that someone is present to accept the delivery.

We will try to deliver your Product(s) within 30 days of the date of your order; however, there may be circumstances where delivery is delayed because of events beyond our control. If this happens we will try to arrange for your Product(s) to be delivered as soon as is reasonably practicable; however, we do not accept any liability for any losses, if any, caused as a result of such delay.

Should you order a number of different Products, we may deliver them in separate deliveries if they are not all available at the same time for delivery.

All Products must be received by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the Products may be retained by the driver. When your Product(s) arrive, it is important that you check the condition of the delivered Product(s)
immediately. If your Products have been damaged in transit, you must refuse the delivery and immediately contact us.

If you sign "Unchecked", "Not Checked" or similar you agree and warrant that you have accepted the Products in the condition that they have been delivered. You agree that Empowered Crystals are not liable for any damage incurred during transit and you agree not
to involve Empowered Crystals in any dispute.

Some Products are so large and heavy that delivery times may be slightly longer. In this case, estimated delivery dates will be given when you place your order.

6. Returns

6.1 Cancellation of order and returning Products

If you have ordered Products, but not received them, you may cancel your order without giving a reason, at any time within 14 days. You will have no obligation and we will refund your money within 14 days. If you wish to return Products once delivered you need to notify us via email at empoweredcrystal.uk@gmail.com within 14 days of receiving the Product(s). The Products need to be returned to us within 14 days of this notification and you will be responsible for covering the delivery costs of returning the Product(s) to us.

6.2 Returning products due to subsequent defects
Please examine the Product(s) received from us immediately when you receive them. If you do not tell us of any defect or problem via email at empoweredcrystal.uk@gmail.com within 30 days of the receipt of the Products, we shall assume that you have accepted them.

Before you return the Products please carefully re-read any instructions supplied with the Product relating to power supply, plugs and sockets.

You must provide us with full and clear details of the defect in question, by emailing us at empoweredcrystal.uk@gmail.com, when it first became apparent and any other information required to enable us to identify or reproduce it.

Upon return, if any defect is found, then we shall repair or replace the Product(s) or refund the full cost you have paid including reasonable costs of returning the Product(s).

Your money will be refunded conditional upon the Product(s) being returned within 30 days, with labels and packaging intact, and you having complied with our Terms. If the Product is returned 30 days after it has been received by you, we are not legally obligated to provide a full refund.

6.3 How we refund
When returning your item, the way you originally paid will determine how we refund you. If the Products were purchased in a promotion or discounted price, you will be refunded for the Product(s) at the price charged within 14 days.

7. Miscellaneous

7.1 Health disclaimer
You acknowledge and agree that Products available are not intended to prevent, treat or diagnose any condition, illness or disease in humans and animals. Nor should the information be considered in whole or in part, express or implied to contain or constitute medical or
psychological advice.

Any advice or other materials are intended for general information purposes only, Empowered Crystals makes no guarantees that the Product(s) provide physical, mental or therapeutic health benefits and does not purport to give medical advice for humans or animals. You should always seek professional advice from your medical physician, doctor or veterinarian or other qualified health care professional in the case of illness or ailments afflicting yourself, the intended recipient of your purchase whether they are human or animal. You acknowledge that Empowered Crystals has advised you of the necessity of doing so.

Empowered Crystals disclaims any responsibility for any harm resulting from the Product(s) and does not guarantee that you will receive any benefits from the Products. You understand and agree that you use the Product(s) and information provided by Empowered Crystals at
your own discretion and risk.

7.2 Intellectual property rights
We will defend the intellectual property rights in connection with our Products including the copyright in the content whether provided by us or by any other content provider (including copyright in: text, graphics, logos, icons, images, audio clips, digital downloads, data and software).

Except as set out below, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or part.

You may not use our name or logos or trademarks or any other Content on any Platforms or Platforms of yours or that of any other person.

7.3 Security of the platforms
You now agree that you will not, and will not allow any other person to:

Modify, copy, or cause damage or unintended effect to any portion of the Platforms, or any software used within it.
Link to our Platforms in any way that would cause the appearance or presentation of the site to be different from what would be seen by a user who accessed the site by typing the URL into a standard browser
Download any part of our Platforms, without our express written consent
Collect or use any product listings, descriptions, or prices
Collect or use any information obtained from or about our Platforms or the content except as intended by this agreement;
Aggregate, copy or duplicate in any manner any of the content or information available from our Platforms, other than as permitted by this agreement or as is reasonably necessary for your use of our Platforms;
Share with a third party any login credentials to our Platforms.

Conditional only upon receipt of prior written approval from us, you may create a hyperlink to our Platforms for the purpose of promoting an interest common to both parties. This licence is conditional upon you not portraying us or any product or service in a false, misleading, derogatory, or otherwise offensive manner. You may not use any logo or other proprietary graphic or trademark of ours as part of the link without our prior written consent.

7.4 Indemnity
You hereby agree to release, defend, indemnify and hold harmless Empowered Crystals and its officers, directors, employees, investors and agents from and against any and all costs, claims, disputes, demands, liabilities, damages, losses and expense, including, without limitation, reasonable legal and accounting fees, arising directly or indirectly from:

Your violation of these Terms and/or the laws in your province, territory or country;
Your breach of these Terms;
Any act, neglect or default by any agent, employee, licensee or customer of yours;
Your use of our Platforms and/or Product(s);
Your interaction with other users of our Platforms;
Personal injury, emotional distress, any third-party claims of bodily injury, death, or damage to real or tangible property that is either directly or indirectly related to your use of our Products or otherwise caused by your negligent or more culpable acts or omissions; or
A breach of the intellectual property rights of any person.

7.5 Limitation of liability
By agreeing to our Terms, you understand that you are solely responsible for your use of our Platforms and Product(s). You acknowledge and agree that to the maximum extent permitted by law Empowered Crystals assumes no liability or responsibility for any direct, indirect,
special, exemplary, punitive, incidental or consequential damages or losses, including, but not limited to, lost profits, loss of data or goodwill, business interruption, service interruption, device damage, system failure, the cost of substitute services or products, or personal injury; whether based on warranty, contract, tort (including negligence), product liability or any other legal theory; which arise directly or indirectly from:

Your use of, or inability to use, our Platforms or our Product(s);
Errors, mistakes or inaccuracies of our Platforms
Any unauthorised access to or use of our secure servers and/or the personal information (if any) stored therein;
Any bugs or viruses, trojan horses, other harmful and malicious software or the like that may be transmitted to or through our Platforms that may in turn infect and damage your device, computer equipment, software, data or other property, including via emails or attachments received from us; or
Any issues or malfunctions in any of our Product(s).

The exclusion and limitations of liabilities detailed above are fundamental elements of the basis of the bargain between Empowered Crystals and you. However, nothing in these Terms shall be interpreted or construed so as to limit or exclude liability that cannot be so limited or excluded under applicable law.

7.6 Hyperlinks and third-party sites
There may be references or hyperlinks to third-party websites which are provided for customer convenience and of which we have no control over. Third party websites may be governed by their own terms and conditions, Empowered Crystals accept no legal responsibility for any content, material or information contained in them.

Empowered Crystals does not warrant, represent, endorse, enforce, guarantee or assume responsibility for any third-party product or information through or in connection with Empowered Crystals. We will not be party to, or in any way monitor any transaction between you and third-party providers. Any such dealings are solely between you and the third-party. You agree that Empowered Crystals will not be responsible for any loss or damage incurred as the result of any such dealings or with respect to any third-party’s use or disclosure of your
personal information that you make available to them. If there is a dispute between you and any third-party, we are under no obligation to become involved and you agree not to involve Empowered Crystals.

7.7 Dispute resolution

You agree that all concerns, disputes or claims in relation to these Terms, the Content and the Products are to be raised in the first instance with Empowered Crystals directly by contacting us at empoweredcrystals.uk@gmail.com

Both parties hereby agree to make all reasonable efforts to resolve any such dispute amicably and on an informal basis.

You and Empowered Crystals agree that any dispute or claim that could not be successful resolved through initial informal dispute resolution efforts, and arise out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof, will be
resolved in a cost-effective binding arbitration.

In this paragraph the term “ADR Provider” means an approved body under the Alternative Dispute Resolution for Consumer Dispute Regulations 2015.

The following terms apply in the event of a dispute between the parties:

We can propose an ADR Provider or will listen to your proposal. If you are in any way concerned, you should read the regulations at: http://ec.europa.eu/consumers/odr/.

Where we provide products or services without specific charge to you, then they are deemed to be provided free of charge, and not to be associated with any other Products for which a charge is made. Accordingly, there is neither contractual nor other obligation upon us in
respect of those products or that service.

8. Severability
If any term or provision of this agreement is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.

The rights and obligations of the parties set out in this agreement shall pass to any permitted successor in title.

9. Changes to our terms
We reserve the right, in our sole discretion, to update or change these Terms at any time.

If we do so, we will notify you of any updates or changes by posting the updated Terms and updating the “Last Updated” date to indicate when the changes are effective.

10. General terms
No failure or delay by any party to exercise any right, power or remedy will operate as a waiver of it nor indicate any intention to reduce that or any other right in the future.

Any communication to be served on either party by the other shall be via email.

This agreement does not give any right to any third party under the Contracts (Rights of Third Parties) Act 1999

11. Force majeure
Neither party shall be liable for any failure or delay in performance of this agreement which is caused by circumstances beyond their reasonable control.

12. Governing law and jurisdiction
These Terms and any dispute, proceedings or claims of whatever nature arising out of or in any way related to these Terms shall be governed by and construed in accordance with the laws of England and Wales.

These Terms (and any non-contractual disputes or claims arising in relation to them) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
